TERMOS E CONDIÇÕES GERAIS
Estes Termos e Condições Gerais (“Termos”) do Aeroporto Internacional de Belo Horizonte ("BH Airport") aplicam-se ao uso do sistema de reserva de estacionamento de veículos e demais produtos e serviços oferecidos pela BH AIRPORT nesse mesmo sistema de reserva ("Produtos").
Quaisquer condições do Cliente que contradigam ou desviem destes Termos não serão reconhecidas, a menos que a BH Airport tenha dado o seu consentimento expresso por escrito. Estes Termos podem ser alterados pela BH Airport a qualquer momento sem aviso prévio.
GLOSSÁRIO
Nomenclaturas usadas neste documento:
- Site: website do sistema de reservas online da BH Airport (https://vendasonline.bh-airport.com.br).
- SAC: Serviço de Atendimento ao Consumidor da BH Airport (0800 037 1547)
- Categoria do Estacionamento: Categorias distintas situadas no local designado para o estacionamento de veículos, contemplando a seguinte divisão: Premium Plus, Premium 1, Premium 2, Premium 3 e Econômico 3.
- Cliente: pessoa física ou jurídica contratante dos Produtos delimitados no presente Termo.
- Estacionamento: : Área delimitada localizada em uma as Categorias do Estacionamento, onde o Cliente poderá estacionar o seu veículo por um determinado período de tempo.
- Bilhete de Confirmação de Tarifa: Bilhete com código QR emitido no site da BH Airport para os fins aqui indicados.
- Momento da Aquisição: Data e horário em que a reserva foi feita.
- Entrada programada: Data e horário previstos de chegada ao Estacionamento, conforme indicados no tíquete de confirmação.
- Saída Programada: Data e horário de saída prevista do Estacionamento, conforme indicados no tíquete de confirmação.
- Duração da Reserva: Tempo de estacionamento acordado desde a entrada programada até a saída programada.
1. DADOS CADASTRAIS
1.1. Ao preencher a Ficha Cadastral - Estacionamento BH Airport (“Ficha Cadastral”) e ter ciência das Normas de Utilização do Estacionamento, o cliente concorda com os presentes termos e condições.
1.2. O preenchimento dos campos da Ficha Cadastral sinalizados com “*” (asterisco) é obrigatório.
1.3. Para fins de controle da BH Airport, deve-se cadastrar o veículo que possivelmente será utilizado na estadia reservada.
1.4. A reserva online do estacionamento é realizada apenas para vagas relativas a veículos de passeio, não sendo permitido o estacionamento de Motos ou veículos pesados.
2. REGRAS DE USO E FUNCIONAMENTO DO ESTACIONAMENTO
2.1. A reserva deverá ser feita com pelo menos 5 (cinco) horas de antecedência da Entrada Programada. Sendo a estadia iniciada no momento de acesso ao Estacionamento, mediante validação do código de acesso (QR Code) comprobatório da reserva.
2.2. A reserva dá direito à utilização de uma vaga indeterminada no pátio escolhido no ato da reserva, mediante uso de um código de acesso (QR Code), emitido através do portal eletrônico da BH Airport. Ressaltando-se que diversas reimpressões do cartão não dão direito a outro acesso, sendo tal ato coibido segundo os ditames legais aplicáveis.
2.3. O valor indicado na reserva não será aplicado caso o Cliente não apresente o código de acesso (QR Code) no momento de entrada no Estacionamento. Nesta hipótese, será aplicado o preço in loco, conforme previsto na tabela de valores do local.
2.4. Para os veículos que possuam TAG Conectcar ou demais serviços de pagamento automático e abertura de cancela aceitos pelo estacionamento, caso o QR Code não seja validado na entrada, a reserva online não será ativada e o valor correspondente da estadia será debitado da conta no serviço de pagamento automático.
2.4.1 No caso de cobrança duplicada em serviços de pagamento automático, poderá ser realizado o estorno mediante a contestação no serviço correspondente, com a apresentação do número e dos detalhes da Reserva Online para que seja avaliada. O reembolso do serviço de pagamento automático será realizado apenas se a estadia estiver registrada no mesmo pátio e período reservado e se a reserva online não tiver sido utilizada no período.
2.5. O veículo que exceder o tempo de permanência contratado incorrerá no pagamento da diferença, a ser calculada conforme tabela de preços in loco vigente, devendo o Cliente comparecer ao guichê de atendimento do Estacionamento ou caixa automático, onde será cobrada a diferença.
2.6. A reserva não dá direito à reentrada, ainda que dentro do período contratado.
2.7. A responsabilidade da BH Airport consiste na guarda do veículo confiado ao estacionamento e nas obrigações decorrentes exclusivamente da prestação de serviços;
2.8. Caso o Cliente verifique que seu veículo encontra-se sinistrado ou apresentando alguma irregularidade, deverá imediatamente comunicar a ocorrência à BH Airport, para os procedimentos internos de verificação para reparação do dano possam ser adotados
2.9. A BH Airport não se responsabiliza por objetos de valor deixados no interior do veículo. Deste modo, recomenda-se que Cliente leve seus pertences consigo, não os armazenando no veículo.
2.10. Os proprietários de veículos Hilux e SW4 agora contam com uma medida de segurança adicional. Ao entrar no estacionamento, será colocada uma trava de rodas no carro, que será retirada assim que o passageiro ou visitante precisar sair do local.
3. REGRAS DE PREÇO E PAGAMENTO
3.1. O pagamento deverá ser feito antecipadamente, no momento da reserva, por meio de cartão de crédito, sendo o valor cobrado correspondente ao tempo de permanência e pátio.
3.2. A reserva já efetuada, com pagamento autorizado, não sofrerá alteração de preço e dará direito ao uso da vaga, que estará disponível ao Cliente no período da estadia./p>
3.3. Caso o processamento da cobrança automática no cartão de crédito não seja efetivado, e tal fato se der no período entre o Momento da Aquisição e a Entrada Programada, o código de acesso será invalidado.
3.4. A reserva é exclusiva para a Categoria do Estacionamento, data e horário da estadia contratada, dando direito ao uso de vaga, que estará disponível ao Cliente.
3.5. As vagas são indeterminadas dentro da Categoria do Estacionamento contratada, e sua utilização se dará de acordo com as orientações de operação local.
3.6. A utilização de vaga seguirá todas as condições gerais de uso do Estacionamento descritas neste termo.
4. REGRAS DE CANCELAMENTO, REEMBOLSO OU ALTERAÇÃO
4.1. A solicitação de alteração de data, horário ou Categoria do Estacionamento da reserva deverá ser realizada pelo Site https://vendasonline.bh-airport.com.br/pt/booking/search/ com no mínimo 5 (cinco) horas de antecedência da Entrada Prevista. Após esse período não é possível alterar a reserva.
4.2. Direito de arrependimento: será permitida a desistência da compra, desde que observadasas regras abaixo:
4.2.1 Até 5 (cinco) horas antes do horário de Entrada Programada - Cancelamentos deverão ser realizados diretamente no site https://vendasonline.bh-airport.com.br/pt/booking/search/.
4.2.2 Após 5 (cinco) horas antes do horário de Entrada Programado - O reembolso deverá ser solicitado mediante contato pelo e-mail vendasonline@bh-airport.com.br e incorrerá na cobrança da primeira diária e estorno do restante do valor pago.
4.3. No caso de não utilização da reserva online por motivo de estadia em outra Categoria do Estacionamento oferecida pela BH Airport em período idêntico ao reservado, mediante apresentação de comprovante de pagamento da Categoria do Estacionamento utilizada pelo e-mail vendasonline@bh-airport.com.br, a reserva online será cancelada e ressarcida em sua totalidade. O ressarcimento estará condicionado à não utilização da reserva online.
4.4. As solicitações de reembolso no caso de “uso parcial” deverão ser realizadas pelo e-mail vendasonline@bh-airport.com.br e obedecerão a seguinte política: será passível de receber a devolução proporcional do valor pago, aquele usuário cuja utilização tenha sido igual ou inferior a 50%(cinquenta por cento) da duração da reserva. Para aquele usuário que utilizou período superior a 50% (cinquenta por cento) da reserva, não haverá devolução de qualquer valor.
4.4.1. Para definição do período de utilização, será considerada como unidade base a “Diária”, independentemente de quantas horas no dia foram efetivamente reservadas; e como “Diária Utilizada” todo e qualquer período que o carro estiver estacionado durante as 24 horas do dia em questão.
4.5. As solicitações de cancelamento ou reembolso deverão ser realizadas em até 30 (trinta) dias corridos, contados a partir da data de Saída Programada.
4.6. O reembolso para todos os casos descritos acima será realizado através de estorno no cartão de crédito utilizado na reserva.

Below we present the Terms and Conditions of Use (“Terms”), a document that lists the main rules that must be observed by everyone who accesses the www.bh-airport.com.br of Bh-Airport responsible for the site or uses its features ("You").

1.1. Feature. www.bh-airport.com.br consists of a platform for users to get to know the Concessionaire, obtain information about the particularities of the business and access relevant documents.
1.2.www.bh-airport.com.br Operating Mode. Users can interact with the Concessionaire by sending messages on Fale Conosco, Airport Accreditation, Ombudsman, among others.
1.3. Legal Age. Access and use of www.bh-airport.com.br is free for everyone, however some features such as registration in certain environments may require acts performed by people over 18 (eighteen) years old, according to current legislation.
1.3.1. In these cases, legal representatives must supervise and represent children and adolescents under the age of 16 (sixteen) years and assist adolescents over the age of 16 (sixteen) years and under 18 (eighteen) years of age, whenever applicable.
1.3.2. BH Airport may refuse, not approve, cancel or limit any requests if You do not provide correct data.
1.3.3. The same will apply when using www.bh-airport.com.br, if it is used fraudulently, as well as if you try or violate these Terms or any legislation in force.
1.4. Eligibility. BH Airport may change the eligibility criteria for accessing and using www.bh-airport.com.br at any time and at its discretion without the need for communication or prior notice to You or any third party.
1.5. E-mails. By providing your data on www.bh-airport.com.br, You agree that you may receive messages with notices and advertising content of products or services from BH Airport and its partners in the email and/or telephone informed in the registration. Through www.bh-airport.com.br You will always have the option of not receiving such communications.
1.6. Presentation of www.bh-airport.com.br. www.bh-airport.com.br and its features are presented to You as they are available, and may undergo constant improvements and updates.
1.6.1. In this case, BH Airport undertakes to preserve the feature of www.bh-airport.com.br with reasonable efforts, with unbroken Links and using a Layout that respects usability and navigability, whenever possible, as well as displaying the features in a clear, complete, precise and sufficient so that there is a correct perception of what is being practiced.
2. USE OF WWW.BH-AIRPORT.COM.BR
2.1. Integrity of www.bh-airport.com.br. You undertake not to access programming areas of www.bh-airport.com.br, its database, source codes or any other set of data available in these environments, as well as not to perform or allow reverse engineering, nor translate, decompile, copy, modify, reproduce, rent, sublicense, publish, disclose, transmit, lend, distribute or otherwise inappropriately dispose of the features of www.bh-airport.com.br.
2.2. No mining. It is forbidden to use www.bh-airport.com.br data mining software, of any type or kind, in addition to any other not typified herein that acts in a similar way.
2.3. Indemnity. In the event of damages to BH Airport or third parties, the person responsible undertakes to bear all obligations to indemnify the injured party, including those whose origin is from acts performed through their Access Account, assuming the liability of legal action or administrative procedure and requesting the exclusion of BH Airport, having to fully bear the related procedural expenses and costs, holding it harmless from damages and encumbrances.
3. CONTENT, SUBMITTED DATA AND INTELLECTUAL PROPERTY
3.1. Contents. Except as otherwise established by these Terms, all information, news, images, illustrations, icons, technologies, brands and other audiovisual or sound content, including the www.bh-airport.com.br software, made available in any language or otherwise, are the exclusive property of BH Airport or licensed by third parties to BH Airport (“Content”). The use of www.bh-airport.com.br does not represent any transfer or license of this property. For this reason, You must not sell the Content in whole or in part by any means, whether for payment or not, knowing that if you do so, you may be penalized civilly and criminally by BH Airport and/or by any third party owner of the Content.
3.1.1. Any possible removal, blocking or suspension of any Content or feature of www.bh-airport.com.br as a result of any claim must always be understood as a demonstration of good faith and an intention to amicably resolve conflicts, never as an acknowledgment of fault or any infringement by BH Airport at the right of a third party.
3.2. Your Data. . You are and will continue to be the owner and holder of all data, information, texts, images, messages or any other material in any way that is submitted and/or shared on www.bh-airport.com.br by You (“Your Data”) and you will be solely responsible for them, and you are solely responsible for respecting the intellectual property of third parties or any other related rights.
3.3. Legality of Your Data. BH Airport will not be obliged to process or treat any of Your Data if there is reason to believe that such processing or treatment may impute to BH Airport any violation of any applicable law or that www.bh-airport.com.br is being used, at the sole discretion of BH Airport, for any illegal, illicit or contrary to morality purposes.

3.5.1. You declare that you are aware that BH Airport, if not at its sole discretion, will not disclose or provide You or any third party with any systemic or algorithmic information related to www.bh-airport.com.br.
4. YOUR PRIVACY AND YOUR PERSONAL DATA
4.1. Personal Data. If You process or transmit information relating to an identified or identifiable natural person (“Personal Data”) within the scope of www.bh-airport.com.br, You will be solely responsible for collecting the required authorizations from the holder of the Personal Data.
4.1.1. BH Airport will monitor, by appropriate means, your own compliance with the respective Personal Data protection obligations, if applicable.

4.3. Collection Purpose. The Records may be used aimed to: (i) identify You and serve You (ii) fulfill the obligations of these Terms (iii) improve www.bh-airport.com.br; (iv) protect rights and obligations related to the use of www.bh-airport.com.br; and (v) comply with a court order and/or an administrative authority.
5. DISCLAIMER AND LIMITATIONS OF LIABILITY
5.1. BH Airport makes its efforts to maintain the continuous and permanent availability of www.bh-airport.com.br. However, there may occasionally be some temporary unavailability due to necessary maintenance or even generated as a result of force majeure, such as natural disasters, failures in communication systems and Internet access, invasive cyber-attacks, or any third party facts that are outside the sphere of surveillance and responsibility of BH Airport.
5.1.1. If this occurs, BH Airport will do everything within its power to restore access to www.bh-airport.com.br as soon as possible, within the technical limitations of its services and third-party services, on which it depends to stay online. For this reason, You are aware that you will not be able to claim indemnification or compensation for damages in the event that www.bh-airport.com.br remains offline, regardless of the reason.
5.1.2. Any maintenance procedures that result in the unavailability of www.bh-airport.com.br for long periods will be informed through BH Airport's official communication channels.
5.2. Without prejudice to other conditions of these Terms, BH Airport is not responsible:
i. For any problems, bugs, glitches or malfunctions that occur on your devices and equipment;
ii. For any direct or indirect damage caused by third party events, for example, but not limited to hacker attacks, system, server or internet connection failures, including software actions that may somehow damage your physical or logical assets as a result of access, use or navigation at www.bh-airport.com.br, as well as the transfer of data, files, images, texts, audios or videos contained at www.bh-airport.com.br ;
iii. By browsing any external links available at www.bh-airport.com.br, being your duty to read the Terms and Conditions of Use and the Privacy Policy of the accessed resource and act as determined; and
iv. 6.4. Nullity. If any provision of these Terms is held to be unenforceable or ineffective, the remainder will continue to apply as normal.
6.5. Communication. You acknowledge that all communication made by e-mail (to the e-mail address provided in your registration) is valid, effective and sufficient for the disclosure of any matter that refers to www.bh-airport.com.br.
6.6. Date and time. www.bh-airport.com.br is based on the official date and time in Brasilia (UTC/GMT -03:00 am).
6.7. Applicable law and venue. These Terms will be interpreted according to Brazilian legislation, in the Portuguese language, and the jurisdiction of the Court of the district of your domicile (You) is elected to settle any dispute, unless the applicable legislation specifically provides for another personal, territorial or functional competence.
7. GLOSSARY
i. BH Airport: CONCESSIONÁRIA DO AEROPORTO INTERNACIONAL DE CONFINS S/A, a legal entity governed by private law, headquartered at Rodovia MG-10 km 09, s/n° Mezzanine; Administration Building; Room B13A, Bairro Aeroporto de Confins, Municipality of Confins, State of Minas Gerais, registered with the CNPJ/MF under No. 19.674.909/0001-53, herein represented as provided for in its Public Deed of Incorporation.
ii. www.bh-airport.com.br: An online tool, made available by BH Airport for the site, consists of a platform for users to get to know the Concessionaire, obtain information about the particularities of the business and access relevant documents.
iii. Anti-Spam: System that prevents unwanted correspondence, such as mass advertising, by blocking messages or moving them to a specific folder.
iv. Communication Channels: 0800 037 1547.
